Welcome and thank you for using Tattooine Masterclass website located at www.tattooinezagreb.com, owned and operated by Tattooine, vl Lidija Petrović - OBRT ; governed by the laws of Croatia, with its registered office in Zagreb, Croatia.

This Terms of Use governs the contractual relationship between Tattooine and each tattoo artist, individual, entity, user, or visitor (hereinafter referred to as “you” or “your”) accessing the website and/or using the Services (as defined below). You and Tattooine shall also hereinafter be referred to collectively as the “Parties” and individually as a “Party.”

By accessing the Website and using the Services, you agree to be bound by these Terms and comply with all applicable laws and regulations. If you do not agree to these Terms, you shall not use the Services or access the Website. Your continued use of the Website and Services constitutes acceptance of these Terms.

Please read these Terms carefully. THESE TERMS INCLUDE AN ARBITRATION SECTION THAT APPLIES TO ALL CLAIMS BROUGHT AGAINST TATTOOINE. PLEASE READ CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS.

Acceptance and Modification of Terms

Tattooine reserves the right, at any time and in its sole discretion, to modify or replace these Terms. You are responsible for reviewing these Terms periodically. Continued access to the Website and use of the Services following modifications shall constitute acceptance of the modified Terms.

Tattooine also reserves the right to modify or replace the Website, in whole or in part, at its sole discretion. If you do not accept any modifications, you may delete your User Account according to these Terms.

Services Provided

Tattooine provides an educational online course ("Tattooine Masterclass”), which includes pre-recorded classes and tutorials on tattooing techniques, equipment, tattoo design, and other theoretical and practical aspects. The Online Seminar, created by Tattooine’s expert team, is offered in Croatian and English and presented in video format. Additional access to an online community is included.

Tattooine reserves the right to cancel, interrupt, reschedule, or modify the classes and tutorials at its sole discretion.

Grant of License

Tattooine grants you a revocable, non-exclusive, non-transferable, non-assignable, non-sublicensable, limited license to use the Website and view the Tattooine Masterclass for which you have paid all required fees, solely for personal, non-commercial, or educational purposes. All other uses are strictly prohibited.

Restrictions: You shall not: (1) reverse engineer, disassemble, decompile, decode, or attempt to gain access to the source code; (2) modify, reproduce, distribute, sell, or create derivative works from the Online Seminar; (3) remove or obscure any copyright or trademark notices; (4) share access to the Tattooine Masterclass to third parties; or (5) use the Online Seminar for any commercial purpose.

User Registration and Security

To access the Services, you must register an account (“User Account”) by providing required information, including but not limited to your full name and email address. You may need to verify your email before accessing the Services. Tattooine reserves the right to deny registration at its discretion.

User Accounts are personal, non-transferable, and may only be used by a single individual. You may not access another user's account or authorize third parties to access your account. Tattooine may deny access at any time for any reason.

By creating an account, you confirm that you are at least 18 years old or, if younger, (1) above 13 years old and (2) supervised by a parent or guardian for all Website and Service use. You must provide accurate and current information. Failure to do so may result in account termination.

You are responsible for maintaining the confidentiality of your login credentials. You must notify Tattooine immediately of any unauthorized use of your account. Tattooine is not liable for any loss due to unauthorized account access, but you may be held liable for losses incurred by Tattooine.

Deletion of User Account

You may delete your User Account by sending a request to [email protected]. Upon request, Tattooine will permanently delete your User Account and associated data within 30 business days. You acknowledge that deleting your account will revoke access to the Online Seminar, and Tattooine shall not be liable for any resulting damages.

Acceptable Use of the Website

You may not use the Website to transmit, distribute, store, or destroy material or information:

In violation of any law or regulation;
That infringes Tattooine’s or third parties’ intellectual property rights;
That violates privacy rights;
That is defamatory, damaging, obscene, threatening, abusive, or hateful;
To upload, post, transmit, or distribute unlawful, harmful, harassing, or hateful content, or content that incites violence, racism, bigotry, sexism, or religious intolerance.

Prohibited activities include, but are not limited to:

Interfering with the Website’s functionality;
Overloading the Website’s infrastructure;
Copying, modifying, or displaying Website content without Tattooine’s written consent;
Accessing non-public areas of the Website;
Testing the Website’s security or breaching authentication measures;
Using unauthorized automated tools to scrape or index the Website;
Impersonating another person or entity;
Sending unsolicited advertisements (“spam”);
Uploading viruses or harmful software;
Violating any applicable law or regulation.

Tattooine reserves the right to take legal action against any violation of these restrictions.

Registration and Access to Online Seminar

Upon successful registration and payment, you will gain access to the Masterclass videos. You may not share, sell, or distribute access to the Services. If Tattooine detects unauthorized activity, it may block your use and terminate access.

You must use the Website and Services for lawful purposes and not engage in prohibited activities such as infringing copyrights, distributing unauthorized copies, or attempting to bypass security measures.

Support Services

Tattooine provides support for queries related to Services, payments, or account issues from: Monday to Friday, 10 AM to 6 PM standard Central European Time (CET; UTC+01:00).

Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of Croatia. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with Croatian law.

Indemnification

You agree to indemnify and hold TATTOOINE harmless from and against any liability, demand, damages, cost, or expense arising from any third-party claim based on: (1) your violation of these Terms; (2) your use or misuse of the Services; (3) your access and participation in the Services; and/or (4) your infringement of TATTOOINE’s Intellectual Property Rights. TATTOOINE shall indemnify and hold you harmless from and against any liability or expense arising from a third-party claim based on any gross negligence or intentional misconduct of TATTOOINE.

In the event of a claim subject to indemnification hereunder, the indemnified Party shall: (1) promptly notify the indemnifying Party of the claim, (2) provide the indemnifying Party with reasonable cooperation and assistance, at the indemnifying Party’s expense, to defend such claim; and (3) allow the indemnifying Party the opportunity to assume the control of the defense and settlement of such claim. The indemnified Party shall be entitled to participate in the defense of such claim and to employ counsel at its own expense to assist in the handling of such claim. The indemnifying Party must obtain the prior written approval from a duly authorized signatory of the indemnified Party prior to entering any settlement affecting the indemnified Party’s rights.

Limitation of Liability

TATTOOINE, ITS AFFILIATES (IF ANY), ITS LICENSORS, VENDORS, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL IN NO EVENT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD-PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, LIQUIDATED OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE OR BUSINESS, ARISING IN WHOLE OR IN PART FROM YOUR ACCESS TO THE WEBSITE AND/OR FROM YOUR USE OR INABILITY TO USE THE SERVICES, EVEN IF TATTOOINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WHILE TATTOOINE TAKES PRECAUTIONS AGAINST SECURITY BREACHES, NO WEBSITE OR INTERNET TRANSMISSION IS COMPLETELY SECURE, AND AS SUCH, TATTOOINE AND ITS AFFILIATES (IF ANY), LICENSORS, AND VENDORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM UNAUTHORIZED ACCESS, HACKING, DATA LOSS, OR OTHER BREACHES THAT MAY OCCUR ON THE WEBSITE AND/OR THROUGH YOUR USE OF THE SERVICES.

YOU ACKNOWLEDGE THAT THE WEBSITE IS FOR EDUCATIONAL PURPOSES ONLY, AND ANY MATERIAL OR INFORMATION CONTAINED IN THE SERVICES ARE FOR GENERAL INFORMATIONAL PURPOSES ONLY.

NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, TATTOOINE (INCLUDING ITS AFFILIATES (IF ANY), ITS LICENSORS, VENDORS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS) LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF ACTION, SHALL AT ALL TIMES BE LIMITED TO A MAXIMUM OF THE TOTAL AMOUNTS PAID BY YOU TO TATTOOINE FOR THE SERVICES DURING THE 12 MONTHS PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

The Website and/or Services may contain links and/or ads to third-party websites or resources. You acknowledge and agree that TATTOOINE shall not be responsible or liable for: (1) the availability or accuracy of such websites or resources; or (2) the content, products, or services on or available from such websites or resources. Links and ads to such websites or resources do not imply any endorsement by TATTOOINE of such websites or resources or the content, products, or services available from such websites or resources.

Your communications, interactions, or business transactions/dealings with any third party found on or through the Website and/or the Services, including any such third party’s terms, conditions, warranties or representations associated with such communications, interactions or business transactions/dealings, shall be solely between you and such third party. You acknowledge and agree that TATTOOINE shall not be liable for any loss or damage incurred by you as the result of any communication, interaction, business transaction or other dealings you may have with any third party found through (1) the Website and/or (2) your use of the Services.

TATTOOINE’ Privacy Policy, available at https://www.tattooinezagreb.com/privacy-policy informs you the usage, storage and processing of the personal information you may provide to TATTOOINE through your access of the Website and/or through your use of the Services. Your election to use the Services via the Website shall be deemed as your acceptance of the terms of our Privacy Policy.

Suspension and Termination

TATTOOINE may suspend or temporarily disable access to all or part of the Website, User Account, or Services if (1) TATTOOINE suspects you of partaking in any illegal activity; (2) TATTOOINE reasonably believes that you have violated these Terms; or (3) applicable law enforcement or other government agencies have requested TATTOOINE to suspend or temporarily disable your access to the Website and/or Services.

If TATTOOINE breaches any of its obligations under these Terms, you may terminate these Terms and close your User Account. Upon termination, TATTOOINE may (1) block your access to all of the Website, (2) block your use of the Services, (3) disable your User Account, and (4) delete all of your data in your User Account.

General Provisions

Non-Exclusivity: The obligations hereunder are non-exclusive. Severability: If any provision is deemed invalid, it shall be omitted without invalidating the remainder. No Waiver: Failure to enforce a provision does not waive future enforcement. No Assignment: These Terms cannot be assigned without prior written consent. Notices: Any required notice must be in writing. Entire Agreement: These Terms represent the entire agreement between the Parties.
